General Terms and Conditions (GTC) – SOLILUNA Jewelry


1. Scope

1.1 These General Terms and Conditions (hereinafter "GTC") of Sabrina Wettl, trading as "Soliluna Jewelry" (hereinafter "Seller"), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods offered in the online shop. Deviating terms and conditions of the Customer are not recognized unless expressly agreed otherwise in writing.

1.2 For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. A business entity, for the purposes of these Terms and Conditions, is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.


2. Conclusion of the contract

2.1 The product descriptions in the seller's online shop do not constitute a binding offer , but rather an invitation to the customer to submit an offer.

2.2 The customer can submit the offer via the order form integrated into the online shop. After selecting the desired goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding offer to purchase the goods in the shopping cart by clicking the order button.

2.3 The order confirmation is sent immediately after the order is submitted and does not yet constitute acceptance of the contract . The seller can accept the customer's offer within five days by:

  • Dispatch of a written order confirmation or order confirmation in text form (fax or email), whereby receipt by the customer is decisive,

  • Delivery of the ordered goods, whereby the receipt of the goods by the customer is decisive,

  • Request for payment after order placement.

The contract is concluded at the point in time when one of the aforementioned alternatives first occurs . The period for accepting the offer begins on the day after the offer is sent and ends at the end of the fifth day. If no acceptance is received, the offer is deemed rejected.

2.4 The contract text will be saved after the order is placed and sent to the customer in written form (e.g., email, fax, letter) together with these Terms and Conditions. Subsequent access to the website is not possible.

2.5 Before submitting a binding order, the customer can identify and correct possible input errors by carefully checking the displayed information.

2.6 Contract conclusion is only possible in German .

2.7 Orders are generally processed via email and an automated ordering process. The customer must ensure that the email address provided is correct.


3. Right of withdrawal

3.1 Consumers generally have a right of withdrawal .

3.2 Further information can be found in the seller's cancellation policy .


4. Prices and Payment Terms

4.1 All prices include VAT where indicated. The seller is a small business within the meaning of the VAT Act. Any shipping costs will be stated separately.

4.2 For deliveries outside the EU, additional costs (customs duties, taxes, bank charges) may apply, which will be borne by the customer.

4.3 The payment methods are displayed in the online shop.


5. Delivery and shipping conditions

5.1 Delivery will be made to the delivery address specified by the customer after receipt of payment.

5.2 If the delivery cannot be made by the transport company, the customer shall bear the costs of the unsuccessful shipment, provided that he is responsible for the impossibility of acceptance.

5.3 Self-collection is not possible for logistical reasons.


6. Retention of title

6.1 Delivered goods remain the property of the seller until full payment has been received .

6.2 If third parties (e.g. Paypal) are used, their terms and conditions apply.


7. Liability for defects (warranty)

7.1 The statutory warranty applies.

7.2 For used goods : Warranty claims are excluded if the defect only appears after one year , except in the case of damage caused by:

  • usual use in construction,

  • Intentional misrepresentation or fraudulent deception by the seller.

7.3 Obvious transport damage must be reported to the supplier immediately and the seller informed.


8. Special conditions for customer-specific processing

8.1 If the customer provides content such as texts or images for processing, he must possess all necessary rights of use and guarantees that no third-party rights are infringed .

8.2 The customer shall indemnify the seller against claims by third parties and shall bear all costs for necessary legal defense , insofar as he is responsible for the infringement of rights.

8.3 The seller may refuse to process the request if the content is unlawful, criminal, or immoral .


9. Applicable Law

Austrian law applies, excluding international sales law. Consumer protection rights remain unaffected.


10. Alternative Dispute Resolution

The EU provides a platform for online dispute resolution : http://ec.europa.eu/consumers/odr/ .
There is no obligation to participate in a dispute resolution procedure, and the seller is not willing to do so.


11. Final Provisions

11.1 If the buyer is an entrepreneur, a legal entity under public law or a special fund under public law, the place of jurisdiction is the seller's place of business.

11.2 Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected , provided that this does not result in an unreasonable disadvantage.
